The Center told the Supreme Court on Tuesday that it was considering taking action on the issue of regulating OTT platforms such as Netflix and Amazon Prime Video. A petitioner went to court to request OTT regulation by an autonomous body. A bench comprising Chief Justice SA Bobde and Justices AS Bopanna and V Ramasubramanian was initially of the view that the petitioner should seek redress from the government, but then asked the government to table its response within six weeks.

Additional Solicitor General Sanjay Jain is reported to have said the Center is considering taking action on the issue of regulating OTT platforms. CJI sought to find out from Jain what action would be and asked him to file a response in six weeks while tagging the case with the pending petition.

Advocacy from defenders Shashank Shekhar Jha and Apurva Arhatia said that with movie theaters unlikely to open anytime soon in the country, OTT / Streaming and various digital media platforms have surely given a way for filmmakers and artists to publish their content without worrying about obtaining discharge certificates for their films and series from the censorship committee.

At present, however, there is no law or autonomous body governing digital content to monitor and manage such digital content and it is made available to the general public without any filtering or filtering. The absence of legislation governing OTT / Streaming platforms becomes evident with each passing day and each new case filed for these reasons. The government is facing the heat to fill this gap with public and judicial regulations; Yet the relevant government departments have done nothing significant to regularize these OTT / Streaming platforms, the advocacy added.

The petition also claimed that one of the streaming platforms signed the self-regulation provided by the Ministry of Information and Broadcasting since February 2020.
